Fraud and Recovery
- Fraud. This Unit investigates allegations of fraud. If fraud is believed to have been committed after a thorough investigation our Investigator, who is contracted through the Sheriff’s Department, will make an arrest and forward the case to the District Attorney’s Office for prosecution. Please contact (607)535-8303 and ask for Fraud & Legal to report suspected fraud.
- Recovery. This Unit is responsible for tracking and recovery of funds due the Department from security deposits, overpayments of assistance, pre-death Medicaid liens, Social Security Interim Assistance, Fraud and Intentional Program Violations, and trusts, among other things.
- Estate recoveries and recoveries of 104-b personal injury liens was contracted out by the Office of the Medicaid Inspector General to HMS, now Gainwell Technologies. If you are an attorney or individual with questions regarding an estate or 104-b lien you can contact Gainwell via telephone at (877)331-1460, fax at (877)476-9126, or by e-mail at email@example.com.
- Fair Hearings. This Unit represents the Department at Fair Hearings for the following Units: APS, Child Care, SNAP, HEAP, MA and TA. Fair Hearing requests must be submitted to OTDA in Albany by phone at (800)342-3334, online at https://otda.ny.gov/hearings/, in writing at NYS Office of Administrative Hearings, Office of Temporary and Disability Assistance, P.O. Box 1930, Albany, NY 12201, or by fax at (518)473-6730.
